PROCEDURE: Joint ownership and exploitation agreement between external entities and EHU
PROCEDURE:
Joint ownership and exploitation agreement between external entities and Euskal Herriko Unibertsitatea concerning the specific results open to protection and/or commercial exploitation within the context of a doctoral thesis.
As laid down in the commitment document established by Article 16 of Chapter IV of the Doctoral Studies Management Regulations, in the case of Doctoral Theses produced in collaboration with enterprises or other R&D and innovation entities, a written agreement is required to establish the percentage ownership and exploitation enjoyed by each party with regard to the results of the research contained in the Doctoral Thesis. This agreement must be signed by a representative of each entity holding such rights.
As a required precondition in order to formalise this agreement: (a) the doctoral student must be enrolled on a doctoral programme of the EHU; (b) the doctoral student must have paid the doctoral enrolment fee; (c) the commitment document must be signed by all parties and uploaded to GAUR (click here for further details regarding the commitment document).
Likewise, formalisation of this agreement is compatible with all doctoral study activities and formats of EHU doctoral students involving an external entity, specifically:
- Cotutelle thesis
- Thesis with industrial distinction
- Thesis in collaboration with external entities
- Research stay at an external entity
- Internship stay
- Co-direction with a member of the doctoral programme outside the EHU in situations other than a cotutelle thesis, thesis with industrial distinction and thesis in collaboration with external entities
- Co-direction with a person outside the EHU who does not belong to the doctoral programme in situations other than a cotutelle thesis, thesis with industrial distinction and thesis in collaboration with external entities
The Joint Ownership and Exploitation Agreement between external entities and EUSKAL HERRIKO UNIBERTSITATEA (EHU) may be formalised when there are specific results open to protection and/or commercial exploitation, normally upon completion of the doctoral thesis. To this end, the EHU thesis director, or in the absence thereof, the director outside the EHU, must send the request for the formalisation of this agreement to the EHU Knowledge Transfer Office ('OTC') by sending an email to iproperty.otri@ehu.eus, attaching the following documentation:
- Commitment document signed by all parties of the ED
- Agreement signed between the external entity and EHU, where applicable.
